Measures for the Administration of high-standard farmland construction projects in Sichuan Province
Chapter I General rules
Article 1 In order to standardize the management of high-standard farmland construction in the province, ensure the quality of construction and achieve the expected objectives of the project, These Measures are formulated in accordance with the "Measures for the Management of Farmland Construction Projects", "Measures for the Quality Management of High-Standard Farmland Construction (Trial)", "Regulations on Government Investment", "Implementation Opinions of the General Office of the Sichuan Provincial People's Government on Effectively Strengthening the Construction of High-standard Farmland to Consolidate and improve food security capabilities" and the relevant provisions of the State and Sichuan Province.
Article 2 The term "high-standard farmland construction" as mentioned in these Measures refers to the activities carried out in order to comprehensively improve the comprehensive production capacity of farmland, such as field renovation, irrigation and drainage, field roads, farmland protection and ecological environmental protection, farmland transmission and distribution, soil improvement and farmland fertility improvement.
The term "high-standard farmland construction projects" as mentioned in these Measures refers to the types of projects such as the construction, renovation and upgrading of high-standard farmland implemented for the purpose of carrying out high-standard farmland construction.
Article 3 The construction of high-standard farmland shall implement a unified management system, unified planning and layout, construction standards, organization and implementation, acceptance and evaluation, and storage of the map above.
Article 4 The construction of high-standard farmland shall implement the working mechanism of provincial overall responsibility, city and county implementation, and social and mass participation. Provincial, municipal (prefecture), county (city, district) agricultural and rural departments, with the cooperation of the leadership of the people's government at the same level and relevant departments, take the lead in organizing the construction of high-standard farmland within their respective administrative areas.
Article 5 The construction of high-standard farmland should adhere to the principles of government-led, scientific planning, equal emphasis on quantity and quality, green ecology, multiple participation, and equal emphasis on construction and management.
Article 6 High-standard farmland construction projects shall follow the management procedures of planning preparation, reserve declaration, plan management, examination and approval, organization and implementation, completion acceptance and other procedures.
Seventh high standard farmland construction projects should strengthen the supervision and management of the whole process to ensure the quality of the project. We will establish and improve a high-standard farmland management and protection system and an evaluation system.
Chapter Two Management responsibilities
Article 8 The Department of Agriculture and Rural Affairs is responsible for the administration and guidance of the construction of high-standard farmland in the province. To take the lead in formulating policies, standards, rules and regulations for high-standard farmland construction in the province; Take the lead in organizing the preparation of the province's high-standard farmland construction plan, and organize the review of the city (prefecture) high-standard farmland construction plan; Organize the completion of the construction tasks issued by the central government, put forward the annual task plan of the province's high-standard farmland construction, and approve the province's annual project implementation plan; Establish a provincial high-standard farmland construction project reserve, and set up a provincial high-standard farmland expert committee and expert database; To organize and carry out the management of high-standard farmland construction projects, and conduct statistical scheduling, supervision and evaluation of high-standard farmland construction projects in the province.
Article 9 The municipal (prefecture) agricultural and rural departments shall be responsible for administering and guiding the construction of high-standard farmland within their respective administrative areas. To take the lead in formulating city (prefecture) high-standard farmland construction plans, and organize the review of county (city, district) high-standard farmland construction plans; To organize and carry out the reserve of municipal (prefecture) high-standard farmland construction projects and the application of annual project implementation plans; to undertake the review and approval, completion acceptance, statistical scheduling, supervision and evaluation of the implementation plans of municipal (prefecture) high-standard farmland construction projects; According to the need to establish the city (state) high standard farmland construction expert database.
Article 10 The agricultural and rural departments of counties (cities and districts) shall be responsible for administering and organizing the implementation of the construction of high-standard farmland within their respective administrative areas. Take the lead in formulating high-standard farmland construction plans for counties (cities and districts), and carry out project reserve work; Organize the preparation of implementation plans for high-standard farmland construction projects and submit them to the municipal (prefecture) agricultural and rural departments for approval; prepare annual project implementation plans and submit them to the municipal (prefecture) agricultural and rural departments for review and summary; Organize project implementation and preliminary acceptance, implement project supervision responsibility, strengthen project quality and safety supervision.
Article 11 The project legal person shall be responsible for the quality and safety of high-standard farmland construction, and the units that undertake the tasks of survey and design, construction, supervision, supply of materials (equipment or components), testing and inspection, evaluation and review of the project shall be responsible for their respective technical services, engineering, product quality and safety in accordance with laws and regulations and contracts.
Article 12 Establish a linkage mechanism for the database of experts on high-standard farmland construction at the provincial and municipal levels. Expert pool Experts cover all specialties involved in the construction of high standard farmland. Warehousing experts should be familiar with high-standard farmland construction work, good conduct, rich business knowledge, practical experience and deputy senior or above professional and technical titles. Experts involved in the construction of high-standard farmland should be fair and impartial, and bear relevant responsibilities according to law. The expert pool at all levels should be adjusted and supplemented in due course.
The agricultural and rural departments of provinces, cities (prefectures) and counties (cities and districts) shall, in principle, draw (select) experts from the expert pool according to the needs of their work. Agricultural and rural departments at the county level may invite intermediate and above professional and technical personnel to participate in relevant work.
13th high-standard farmland construction projects adhere to the participation of multiple parties, respect the will of farmers, safeguard farmers' rights and interests, and guide the farmers, village collective economic organizations, new agricultural business entities and all kinds of social capital to participate in the design, construction, acceptance, operation management and protection of high-standard farmland construction projects.
Chapter III planning and project reserve
14th high standard farmland construction projects adhere to planning first. The project planning follows the principle of "centralized contiguic, overall promotion, and phased construction", clarifies the regional layout of high-standard farmland construction, focuses on permanent basic farmland, and gives priority to the construction of high-standard farmland in functional areas of grain production, important agricultural product production reserves, and large and medium-sized irrigation areas. It is prohibited to plan high-standard farmland construction projects in strictly controlled cultivated land, areas within the red line of ecological protection, areas within the boundaries of urban development, areas of nature reserves (land), areas that return farmland to forest areas, areas that return grazing to grassland, rivers, lakes, water surface of reservoirs and their protection areas.
15th Department of Agriculture and Rural Affairs according to the national high standard farmland construction plan, take the lead in organizing the preparation of the province's high standard farmland construction plan, according to the procedures to be approved by the provincial people's government issued and implemented, and reported to the Ministry of Agriculture and Rural Affairs for the record.
16th municipal (prefecture) agricultural and rural departments docking provincial high-standard farmland construction planning, leading the preparation of municipal (prefecture) high-standard farmland construction planning, and natural resources, water conservancy and other planning.
Municipal (prefecture) high-standard farmland construction plan reviewed by the Department of Agriculture and Rural Affairs, issued by the municipal (prefecture) people's government after approval, and reported to the Department of Agriculture and Rural Affairs for the record.
17th county (city, district) agricultural and rural departments docking provincial and city (prefecture) high-standard farmland construction plans, leading the preparation of county (city, district) high-standard farmland construction plans, and natural resources, water conservancy and other departments planning.
After the county (city, district) high-standard farmland construction plan is reviewed by the municipal (prefecture) agricultural and rural departments, it shall be issued and implemented after approval by the county (city, district) people's government, and submitted to the Department of Agriculture and Rural Affairs and the municipal (prefecture) agricultural and rural departments for the record.
18th high-standard farmland construction projects to implement the normal declaration and reserve management system.
County (city, district) agricultural and rural departments according to the plan, comprehensive consideration of water source security, infrastructure status, construction cycle, capital investment, farmers' willingness, implementation benefits and other factors, reasonably determine the scale of individual project construction, establish a county-level project reserve, timely report to the city (state) agricultural and rural departments.
Municipal (prefecture) agricultural and rural departments summarize the projects declared by counties (cities and districts) to form a municipal project reserve; Make recommendations to the Department of Agriculture and Rural Affairs on a regular basis, and make recommendations on the priority of project implementation.
The Department of Agriculture and Rural Affairs summarizes the municipal project reserve pool to form the province's high-standard farmland construction project reserve pool, which is an important basis for arranging the annual task of high-standard farmland construction.
Article 19 High-standard farmland construction project reserves shall be dynamically managed. County (city, district) agricultural and rural departments shall plan projects in advance according to the high-standard farmland construction planning within their administrative areas, and the projects that meet the warehousing requirements shall be put into warehousing step by step according to procedures; Timely delivery of implemented projects.
Chapter four: Plan management and approval
Article 20 The Department of Agriculture and Rural Affairs shall report the annual construction task requirements to the Ministry of Agriculture and Rural Affairs in accordance with the high-standard farmland construction planning, project reserves, and county-level needs.
21st Department of Agriculture and Rural Affairs according to the province's annual high-standard farmland construction tasks, according to the province's high-standard farmland construction planning, project reserves and supervision and evaluation, overall calculation of the city (state) annual construction tasks, in accordance with the reserve priority order to decompose to the county (city, district), the implementation of the reserve project, and timely issue annual construction tasks. In principle, the annual construction tasks assigned should be consistent with the construction scale of reserve projects.

Article 23 The implementation plan shall be prepared by an institution with corresponding survey and design qualifications.
The design unit to prepare the implementation plan should be equipped with relevant professional technical personnel according to the main construction content of the project, the design personnel should go into the project area to investigate the current situation of farmland infrastructure, the quantity and quality of arable land, solicit the opinions of rural collective economic organizations and farmers, and carry out field mapping and investigation.
Article 24 The preparation of the implementation plan shall be based on the Technical Specifications for High-standard Farmland Construction in Sichuan Province, relevant national standards, industry standards and requirements of industry authorities. The implementation plan includes report text, design drawing, general (pre-calculation) book and other materials, and reaches the depth of construction design.
Article 25 High-standard farmland construction mainly includes the following construction contents:
(A) field (land) renovation, mainly including field (soil) type adjustment, field (soil) ridge construction project, soil layer stripping and backfilling.
(2) Irrigation and drainage, mainly including the construction and renovation of field irrigation and drainage channels (pipes) and buildings (structures) in the project area or mainly serving the project area, as well as the overall development of efficient water-saving irrigation projects.
(3) Field roads, mainly including field roads (machine-tilled roads), production roads, agricultural machinery access to the field and wrong lanes, end turning points and other supporting projects.
(4) Farmland protection and ecological environmental protection, mainly including farmland shelterbelts, bank slope protection, gully control, slope protection and other projects.
(5) Farmland power transmission and distribution, mainly including the transmission line engineering and power transformation and distribution facilities needed to provide power guarantee for pumping stations, motor Wells and information engineering.
(6) Farmland fertility improvement, mainly including soil improvement, removal of obstacle soil layer, soil fertilizer and so on.
Article 26 The municipal (prefecture) and county (city, district) agricultural and rural departments shall, before project application and project implementation plan approval, actively connect with the financial departments, report to the people's government at the same level, and clarify the amount and source of financial subsidies at the same level.
Article 27 County (city, district) agricultural and rural departments shall submit the project implementation plan to the municipal (state) agricultural and rural departments for approval within the prescribed time limit.
The municipal (prefecture) agricultural and rural departments shall organize or entrust third-party institutions to carry out the review of implementation plans and strictly implement the review procedures.
The feasible projects reviewed by experts shall be publicized to the public (except for the content involving state secrets), and the publicity period shall not be less than 5 working days. The municipal (prefecture) agricultural and rural departments shall timely approve the projects that have no objection to the publicity; If there is any objection to the publicity, it shall be approved in a timely manner after the expert proves that it meets the requirements.
28th county (city, district) agricultural and rural departments in accordance with the approved project implementation plan, the county (city, district) high-standard farmland construction annual project implementation plan submitted to the city (prefecture) agricultural and rural departments.
The municipal (prefecture) agricultural and rural department shall review and review the annual project implementation plan of the county (city or district), and summarize the annual project implementation plan of the city (prefecture) and submit it to the Department of Agriculture and Rural Affairs.
The Department of Agriculture and Rural Affairs is responsible for approving the province's annual project implementation plan and timely reporting to the Ministry of Agriculture and Rural Affairs for the record.
After the approval of the implementation plan and the annual project implementation plan, in principle, no adjustment or change shall be made, and any change shall be submitted for approval according to the procedure.
Chapter V Organization and implementation
29th county (city, district) agricultural and rural departments should be in strict accordance with the approved high-standard farmland construction annual project implementation plan and project implementation plan, completed on time, to achieve the expected goals of the project.
The construction period of high standard farmland construction projects is generally 1-2 years.
Article 30 High-standard farmland construction shall implement the project legal person system, in strict accordance with the national and provincial provisions on tendering and bidding, government procurement, contract management, project supervision, capital and project publicity.
Project construction, supervision and other units shall have the corresponding qualifications and the necessary technical force and equipment for the implementation of the project.
31st high standard farmland construction project legal person (owner), design, supervision, construction and other participating units shall, in accordance with the relevant provisions, establish and improve the project quality, safety management and supervision system, strictly control the quality and safety, to ensure the project construction progress, quality and safety.
The county (city, district) agricultural and rural departments shall strengthen the supervision and management of the organizations and full-time personnel dispatched to the site by the participating units. Where conditions permit, the county (city or district) shall arrange relevant engineering quality supervision agencies to carry out project quality supervision, and carry out spot checks on project construction quality (including raw materials, intermediate products and finished products) and safety from time to time, and the participating units shall take the initiative to accept supervision and inspection.
Article 32 Project implementation shall be carried out in strict accordance with the annual implementation plan and implementation plan approval, and shall not be adjusted or terminated without authorization. If it is really necessary to adjust or terminate, the examination and approval shall be handled in accordance with the principle of "who approves and who adjusts" and in accordance with relevant provisions.
Article 33 The municipal (prefecture) and county (city, district) agricultural and rural departments shall strictly control the adjustment and change. The financial funds involved in the cumulative program adjustment by project shall not exceed 10% of the total project investment, and meet the relevant requirements of government investment project management; It shall not reduce the construction task, reduce the construction standard or delay the completion time; No adjustment of construction sites or construction contents shall be made without approval.
Article 34 Due to major planning adjustment, major project construction area at a higher level or major natural disasters and other force majeure affecting the implementation of high-standard farmland construction projects, it is necessary to adjust the scope of part of the project area, the county (city, district) agricultural and rural departments to apply, and report to the municipal (prefecture) agricultural and rural departments and the Department of Agriculture and Rural Affairs after approval, The adjustment plan shall be examined and approved by the municipal (state) agricultural and rural departments.
35th need to terminate the project, by the county (city, district) agricultural and rural departments to apply, explain the reasons and put forward proposals for project funding arrangements, submitted to the municipal (prefecture) agricultural and rural departments for review. If the situation is true, the municipal (prefecture) department of Agriculture and rural Affairs shall issue a review opinion and report it to the Department of Agriculture and Rural Affairs for examination and approval and the Ministry of Agriculture and Rural Affairs for the record.
Article 36 All localities are encouraged to actively carry out pilot exploration of project construction modes, sum up experience and promote them within the scope permitted by relevant national and provincial policies. We will support the construction of high-standard farmland through construction first and compensation later, reward instead of compensation, and work instead of relief.
According to the actual situation in their own regions, all localities may adopt such methods as "building first and making up later" to simplify operation procedures, and organize qualified rural collective economic organizations, new agricultural business entities, and agriculture-related enterprises to independently implement high-standard farmland construction projects.
"Build first and make up later" is oriented by financial capital investment, and the financial subsidy to the project owner does not exceed 50% of the total investment of the project. The owner unit shall, in accordance with the approved annual implementation plan and implementation plan, raise funds by itself and complete the construction within the prescribed time limit. After the construction project or construction contents pass the preliminary acceptance examination organized by the agricultural and rural departments of the county (city or district), a certain proportion of financial subsidy funds may be allocated; After the municipal (prefecture) agricultural and rural departments organize the completion and acceptance, the remaining financial subsidy funds will be allocated.
The municipal (prefecture) agricultural and rural departments may, together with the relevant departments of the people's governments at the same level, formulate measures for the implementation of the management of high-standard farmland construction projects implemented in the way of "building first and making up later". County (city, district) agricultural and rural departments shall select project supervision units to supervise the implementation.
Chapter VI Project acceptance
Article 37 The owner unit shall organize the design, supervision, construction and other units to carry out phased acceptance of concealed projects and individual projects in a timely manner, and shall organize the construction unit to rectify the problems found.
Article 38 After the completion of the project and the phased acceptance, the county (city, district) agricultural and rural departments shall organize relevant departments, participating units, the township (town) people's government of the project, rural collective economic organizations and representatives of the beneficiaries to carry out preliminary acceptance of the project, and rectify the problems found within a time limit. After the completion of the rectification, the county (city, district) agricultural and rural departments shall issue preliminary acceptance opinions.
After the preliminary acceptance is passed, the county (city, district) agricultural and rural departments shall submit an application for completion acceptance to the municipal (state) agricultural and rural departments, and the application report shall be attached with the preliminary acceptance opinions, project settlement (final accounts) audit report, etc.
Article 39 Project completion acceptance shall meet the following conditions:
(A) according to the approved project implementation plan to complete the construction content and meet the quality requirements; If there are design adjustments, the construction contents shall be completed according to the project approval change document and meet the quality requirements; Complete project as-built drawing.
(2) The main equipment and supporting facilities of the project run normally after debugging, and achieve the project design objectives.
(3) The project settlement (final accounts) has been completed and audited by a qualified institution.
(4) Preliminary work, bidding, government procurement, supervision, construction management data and the corresponding completed drawings and other technical data are complete and complete, and complete the classification of documents and materials.
(5) Preliminary acceptance of the project has been completed.
Article 40 In accordance with the principle of "who approves and who accepts", the municipal (state) agricultural and rural departments shall organize relevant departments to carry out the completion acceptance inspection, or entrust a third-party agency to undertake the specific responsibility. The municipal (prefecture) agricultural and rural department shall organize a comprehensive acceptance within 60 days after receiving the completion acceptance application report, and ensure the completion of the completion acceptance within six months after the completion of the project.
If the completion and acceptance pass, the municipal (prefecture) agricultural and rural department will issue the "Certificate of Completion and Acceptance of High Standard Farmland Construction Project" in the unified format of the Ministry of Agriculture and Rural Affairs. The county (city, district) agricultural and rural departments shall set up unified and standardized information billboards and signs in the project area.
Organize and carry out financial final accounts of completion in a timely manner after passing the completion acceptance.
Article 41 The municipal (prefecture) agricultural and rural departments shall timely report the acceptance results to the Department of Agriculture and Rural Affairs for the record.
Chapter VII information management
Article 42 All localities should strengthen the information management of high-standard farmland construction projects, relying on the national farmland construction comprehensive monitoring and supervision platform and the transfer payment management platform of the Ministry of Agriculture and Rural Affairs, etc., to carry out the annual implementation plan filing, project scheduling, project acceptance, storage of the chart above, statistical investigation and other work.
County (city, district) agricultural and rural departments are responsible for collecting and reporting the basic data of high-standard farmland construction; The Department of Agriculture and Rural Affairs and the municipal (state) Department of agriculture and rural Affairs shall be responsible for reviewing, summarizing and reporting according to the authority of the system.
Article 43 The system of regular scheduling and statistical investigation shall be implemented for high-standard farmland construction projects.
Article 44 The work above shall be carried out in accordance with the three stages of declaration, completion and acceptance.
County (city, district) agricultural and rural departments in the application stage, report the project vector data, after the city (state) agricultural and rural departments review, the national farmland construction comprehensive monitoring and supervision platform input the basic information of the project, reported to the Ministry of Agriculture and rural areas; In the completion stage and acceptance stage need to modify the storage information above, after the municipal (state) agriculture and rural department review, agriculture and rural Department review, in accordance with the declaration stage process to modify and improve.
Article 45 All localities are encouraged to support the use of information technology to carry out high-standard farmland construction and management, and promote the digitalization of high-standard farmland.
Chapter VIII Administration, protection and utilization
Article 46 The municipal (prefecture) and county (city, district) agricultural and rural departments shall formulate a high-standard system for the management and protection of farmland engineering facilities, and strengthen industry supervision and guidance. According to "who benefits, who manages and protects; The principle of "who uses, who manages and protects" shall be implemented to implement the main body, responsibility, funds, and personnel of the management and protection, and ensure the normal operation of the project within the designed service period.
Article 47 After the completion and acceptance of the project, the county (city, district) agricultural and rural departments shall promptly deliver the assets to the people's government of the township (town) of the project and the village collective economic organizations.
In accordance with the relevant requirements of equity quantification reform, the assets formed by the construction of high-standard farmland should be quantified as the equity of village collectives and farmers, so as to strengthen the village collective economy and increase farmers' income.
Article 48 The county (city, district) agricultural and rural departments shall implement the main body of the management and protection of high-standard farmland engineering facilities to the township (town) or village. If there are cultivated land transfer subjects, the management and protection subjects entrust the management and protection subjects, and the two parties sign an agreement to implement the management and protection responsibilities.
Article 49 The city (prefecture), county (city, district) shall establish a reasonable guarantee mechanism for the management and protection funds of high-standard farmland engineering facilities, raise funds through various channels and ways, and implement the management and protection funds.
Article 50 Farmland of high standard that has been built shall be classified as permanent basic farmland and subject to special protection. No unit or individual may damage, occupy or change the purpose without authorization. The occupation of high-standard farmland approved by law shall be supplemented in a timely manner to ensure that the quantity and quality are not reduced. In principle, all high-standard farmland is used for food production, and we will resolutely curb "non-agricultural" and prevent "non-grain".
Chapter IX Supervision and administration
Article 51 Agricultural and rural departments at all levels shall, in accordance with the Regulations of the People's Republic of China on the Disclosure of Government Information and other relevant provisions, disclose information related to high-standard farmland construction projects and accept social supervision.
Article 52 Agricultural and rural departments at all levels shall formulate and implement internal control systems to prevent and control the management risks of high-standard farmland construction projects. We will strengthen supervision and management of the whole process before, during and after the event, and promptly correct problems when they are discovered.
Article 53 All localities shall strengthen the supervision and evaluation of high-standard farmland construction projects. The Department of Agriculture and Rural Affairs shall organize and carry out provincial random inspection of completion acceptance every year, and carry out random inspection of no less than 10% of completed projects; The city (state) high-standard farmland construction projects were comprehensively evaluated. The municipal (prefecture) agricultural and rural departments shall conduct comprehensive evaluation of high-standard farmland construction projects in counties (cities and districts) within their administrative areas every year.
County (city, district) agricultural and rural departments to participate in the construction of units and personnel do not perform their duties correctly, should be ordered to correct, refuse to rectify in accordance with the relevant provisions and contract to deal with, and notify the county (city, district) people's government relevant departments in charge of handling in accordance with the relevant provisions.
Article 54 If the agricultural and rural departments at all levels find serious violations of laws and regulations during the implementation of high-standard farmland construction projects, they shall promptly terminate the implementation of the projects, assist the relevant departments to recover the project financial funds, and investigate the relevant personnel for responsibility according to law and regulations.
Article 55 The agricultural and rural departments at all levels shall actively cooperate with the supervision, inspection and audit of the relevant departments, formulate plans for the problems found in a timely manner, and organize the rectification of the problems.
Article 56 Agricultural and rural departments at all levels shall strengthen the archive management of high-standard farmland construction projects, establish complete project archives, collect, sort out, file and archive project archives in a timely manner in accordance with relevant provisions, and ensure the authenticity, integrity and standardization of project archives.
Chapter X Supplementary Provisions
Article 57 These measures are procedural provisions, and matters related to the management of funds and the management of investment plans within the central budget shall be implemented in accordance with relevant provisions.
Article 58 The municipal (prefecture), county (city, district) agricultural and rural departments may, in accordance with these Measures and in light of the actual local conditions, formulate specific implementation measures and report them to the Department of Agriculture and Rural Affairs for the record.
Article 59 The Department of Agriculture and Rural Affairs shall be responsible for the interpretation of these measures.
Article 60 Before the implementation of these Measures, the high-standard farmland construction projects that have been approved are still implemented in accordance with the original provisions. These Measures shall come into force on December 9, 2023 and be valid for 5 years. The Implementation Rules of Sichuan Province's Farmland Construction Project Management Measures shall be repealed simultaneously.
